Legacy Assured - Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the Legacy Assured website (https://legacyassured.io/) and services (together with the website, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Definitions
"Legacy Assured", "we", "us" or "our" means the entity operating the Legacy Assured platform.
"User", "you", or "your" means any individual who registers for, accesses or uses the Service, including account holders, next of kin, and other authorised users.
"Account" means your Legacy Assured account and associated record of information.
"Next of Kin" means a person you designate as someone who may access your Account when your death is confirmed, in accordance with applicable law and these Terms.
"Service" means the Legacy Assured website, platform, mobile interfaces, and related services, including the creation, storage, and management of records and documents.
2. Scope and Applicability
2.1 These Terms apply to all use of the Service by Users, regardless of nationality or place of residence.
2.2 You may access and register for the Service from any country. However, Legacy Assured does not represent that the Service is lawful or appropriate for use in every jurisdiction.
2.3 Where the Service is used in conjunction with regulated activities (such as financial services, legal advice, will-writing or estate planning), you remain responsible for complying with local laws and obtaining appropriate professional advice. Legacy Assured is not a law firm, bank, insurer, or licensed financial adviser.
3. Eligibility
3.1 You must be at least 18 years old to register for an Account.
3.2 If you are accessing or using the Service on behalf of another person (for example, as an executor or adviser), you confirm that you have authority to do so and that both you and the person you represent agree to these Terms.
3.3 If you create an Account for another person (for example, a parent or spouse), you must obtain their informed consent.
4. Account Registration and Use
4.1 You must provide accurate, current and complete information during registration and keep it up to date.
4.2 You must not create an Account for the purpose of impersonating another person or breaching any third-party right.
4.3 You are responsible for maintaining the confidentiality of your password and other security credentials.
4.4 You must promptly notify Legacy Assured of any unauthorised access to your Account or suspicious activity.
4.5 Legacy Assured may suspend or terminate your Account if you breach these Terms or if your activity poses a security, fraud or compliance risk.
5. Records and Information
5.1 Legacy Assured provides a secure record of your information, including details of accounts, relationships, and documents you choose to store.
5.2 You retain ownership of the information you provide. Legacy Assured does not claim ownership over your data or content.
5.3 Legacy Assured may process your information in accordance with our Privacy Policy, including for the purpose of providing and improving the Service, preventing fraud, and complying with legal obligations.
5.4 Legacy Assured does not:
- replace your legal obligations (for example, to maintain valid wills or powers of attorney);
- provide legal, tax or financial advice; or
- execute or manage financial transactions, asset transfers or estate administration.
Legacy Assured is an information and record-keeping platform, not a fiduciary, executor or trustee. You are responsible for ensuring your estate and legal arrangements are valid and sufficient under local law.
6. Access by Next of Kin and Other Designated Users
6.1 You must designate one or more Next of Kin or other authorised persons who may access your Account when your death is confirmed, in accordance with applicable law and Legacy Assured procedures.
6.2 Next of Kin or authorised users may only access your Account after Legacy Assured has confirmed your death to the required standard (for example, by upload of an official death certificate or other irrefutable evidence acceptable to Legacy Assured).
6.3 You may add, update or remove Next of Kin or authorised users at any time while you are alive.
6.4 Legacy Assured may require documentation, identity verification and other checks from Next of Kin or authorised users before granting access, in accordance with applicable law and security standards.
6.5 Legacy Assured does not guarantee that any third-party institution (for example, a bank or insurer) will accept or act on information you record in the Service. You remain responsible for notifying third parties in accordance with their own requirements.
7. Security and Data Protection
7.1 Legacy Assured implements technical and organisational measures designed to protect your information, including encryption in transit and at rest, access controls, and secure authentication.
7.2 However, no online platform can be completely immune from risk of breach, loss or unauthorised access. You understand that Legacy Assured does not provide absolute guarantees of security.
7.3 You must not deliberately introduce viruses, malware or other harmful code into the Service.
7.4 Legacy Assured may store your information in cloud infrastructure within or outside the jurisdiction where you reside, subject to appropriate security and contractual safeguards.
7.5 Legacy Assured may retain your information for as long as your Account remains active and for a period after deletion, as required by law or to defend legitimate business interests, after which it will be securely deleted or anonymised.
8. Restricted Use
You must not use the Service:
8.1 to store or transmit information that is illegal, defamatory, abusive, threatening, pornographic, or invasive of privacy;
8.2 in a way that breaches any third-party rights (including intellectual property, privacy or contractual rights);
8.3 to engage in fraud, identity theft, money laundering or other illegal activity;
8.4 to circumvent access controls, security measures, or technical restrictions of the Service; or
8.5 for any commercial, marketing or resale purpose without our prior written consent.
Legacy Assured may remove or restrict access to any content that appears to violate these rules or applicable law.
9. Free Service and Future Changes
9.1 The core Service (for individual users) is provided free of charge. You do not pay a subscription fee to create or maintain your Account.
9.2 Legacy Assured may, in the future, introduce optional paid features, premium plans, or partner services, but such changes will not affect your ability to continue using the core record-keeping functionality for your existing Account in a way that materially undermines your prior expectations.
9.3 Legacy Assured may change the features, access requirements or structure of the Service at any time by updating these Terms and providing prior notice where reasonably practicable. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.
10. Third-Party Providers and Referrals
10.1 Legacy Assured may refer you to third-party service providers (for example, will-writers, legal firms, funeral planners, insurance providers or estate administrators).
10.2 These third-party relationships are between you and the provider; Legacy Assured does not guarantee or assume responsibility for the quality, legality, reliability or suitability of their services.
10.3 Legacy Assured may receive referral or marketing fees from certain partners. This does not affect your rights or the nature of our core record-keeping service.
11. Disclaimers and Limitations of Liability
11.1 Legacy Assured provides the Service "as is" and "as available". To the maximum extent permitted by law, Legacy Assured disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.2 Legacy Assured does not guarantee that the Service will be uninterrupted, error-free, secure or suitable for your specific circumstances.
11.3 Legacy Assured is not liable for any loss, damage, cost or expense arising from:
- your failure to maintain valid legal documents or comply with local law;
- any third-party institution's refusal or delay in acting on information stored in the Service;
- unauthorised access to your Account resulting from your failure to comply with security obligations; or
- decisions or omissions made by your executors, Next of Kin, or third-party providers.
11.4 In jurisdictions where limitations of liability apply:
- to the extent permitted by law, Legacy Assured's total liability to you in any claim arising from these Terms shall be limited to an amount equal to the fees (if any) you have paid to Legacy Assured in the 12 months preceding the claim;
- the above shall not apply to liability for death or personal injury caused by gross negligence or wilful misconduct, or to liability that cannot be excluded or limited by law.
12. Termination
12.1 You may terminate your Account at any time by deleting your Account through the Service or by contacting Legacy Assured.
12.2 Legacy Assured may terminate your Account with or without notice if you breach these Terms, if required by law, or if your Account has been inactive for a prolonged period.
12.3 Upon termination, Legacy Assured will no longer grant you access to your Account, subject to any legal or regulatory retention requirements. You should ensure you download or otherwise record any information you wish to keep before deletion.
13. Governing Law and Jurisdiction
13.1 These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles.
13.2 You and Legacy Assured agree that the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except:
- where local law requires that disputes brought by consumers in certain jurisdictions must be resolved in their local jurisdiction; or
- where mandatory local law otherwise determines the competence of courts.
13.3 The provisions of this section apply regardless of your country of residence or where you access the Service, and you expressly waive any objection to venue in the courts of England and Wales.
14. Cross-Border Use and Local Laws
14.1 You may access the Service from and use it in any country. Legacy Assured does not block users solely by jurisdiction, but you remain responsible for ensuring that your use of the Service complies with local laws and regulations.
14.2 Where local law imposes additional requirements (for example, data protection, succession, or identity-verification rules), those requirements apply to you and do not reduce your obligations under these Terms.
14.3 Legacy Assured may adapt certain Service features, access conditions, or data-handling practices to comply with local laws in specific jurisdictions as the Service is formally launched in those markets (for example, the UAE, UK, Singapore, European Economic Area, Switzerland, South East Asia, US, and Canada). Such changes will be reflected in these Terms, the Privacy Policy, or in separate notices for the relevant markets.
15. Changes to These Terms
15.1 Legacy Assured may update these Terms to reflect changes in law, our Service, or business practices.
15.2 Changes will be posted on this page with a revised "Last updated" date. Where material changes are made, Legacy Assured will, where reasonably practicable, notify Users via email or in-account messages.
15.3 Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
16. General Provisions
16.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.
16.2 Failure by Legacy Assured to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
16.3 These Terms, together with the Privacy Policy and any other documents expressly incorporated, constitute the entire agreement between you and Legacy Assured regarding the Service.
16.4 Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and Legacy Assured.
